These Terms may be updated from time to time, and your continued use of the Services constitutes acceptance of any changes. We will notify you of material changes as described in Section 15.

Agreement Formation: Your agreement with us includes these Terms and our Privacy Policy, which is incorporated by reference.

2. Definitions

For purposes of these Terms, the following definitions apply:

"Platform" RentSmart's website, mobile applications, and related technology infrastructure

"Agent" Registered real estate agent, as authorized representative listing properties
"Landlord" Property owner, manager, or authorized representative listing properties
"Tenant" Individual seeking to rent or currently renting a property

"Content" Text, images, videos, documents, and other materials posted on our Platform
"Transaction" Any rental agreement, application, payment, or interaction facilitated through our Services

3. Eligibility

To use our Services, you must:

  • Be at least 18 years old
  • Have the legal capacity to enter into binding agreements
  • Not be prohibited from using our Services under applicable law
  • Reside in a jurisdiction where our Services are available
  • Provide accurate and complete information during registration
Account Restrictions

You may not create an account if you:

  • Are listed on any government prohibited persons list

Platform Role: We facilitate connections between users but are not a party to rental agreements. We do not guarantee the accuracy of listings or the conduct of users.

5. User Accounts

Account Creation

  • One person may maintain only one account unless authorized

Content Standards

RentSmart Intellectual Property

Our Platform and Services contain proprietary content including:

  • Trademarks, logos, and branding

  • Database compilation and organization
License to Use: We grant you a limited, non-exclusive license to use our Services for their intended purpose. This license terminates when your account is closed.

8. Transactions & Payments

Payment Terms
  • All payments are processed through authorized payment processors
  • You must provide valid payment information
  • Fees are charged as described in our pricing structure
  • You are responsible for all taxes and fees
Subscription Services

For subscription-based services:

  • Subscriptions do not automatically renew.
  • We may modify subscription terms with advance notice

Rental Transactions
  • Rental agreements are between landlords and tenants
  • We do not collect and distribute rent payments
  • We do not hold security deposits in compliance with local laws

  • Consolidated or representative proceaive the dings are prohibited
30-Day Opt-Out: You may opt out of arbitration by sending written notice within 30 days of account creation to legal@rentsmart.com.
